1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of digit-me.com and the DIGIT-ME services (the “Services”) provided by DIGIT ME, LLC, a Delaware limited liability company with its registered office at 2810 N Church St STE 90854, Wilmington, DE 19802, United States (“DIGIT-ME”, “we”, “us”). By creating an account, making a purchase or using the Services, you agree to these Terms, to our Refund Policy and to our Privacy Policy. If you use the Services on behalf of an organization, you represent that you are authorized to bind it, and “you” refers to that organization.

2. Eligibility and business use

The Services are designed for businesses, agencies and professionals. You must be at least 18 years old and able to enter into a binding contract. By purchasing, you confirm that you are acting for purposes related to your trade, business or profession.

You may not use the Services if you are located in a country subject to a comprehensive U.S. embargo, or if you are named on a U.S. government list of prohibited or restricted parties.

3. The Services

DIGIT-ME provides automated audits of websites and of how AI assistants and search engines present a business: AI visibility, AI readiness, website growth and compliance. Results are delivered as online reports, optional email alerts and a report assistant (“Copilot”).

Reports are produced automatically by software and AI models, without human review. AI visibility is measured by asking buyer questions to third-party AI engines (such as ChatGPT, Gemini, Perplexity, Claude and Google AI Overviews) through the interfaces available to us at the time of the audit. AI answers vary over time and between runs: measurements describe the sample tested on a given date. We do not guarantee any ranking, visibility, traffic or revenue outcome.

Third-party AI engines are independent services that we do not control. We may add, remove or replace measured engines, features or data sources at any time, in particular when a provider changes or discontinues its service.

4. Free scans and public score pages

Anyone may run a limited free scan of a publicly accessible website. Free scan results may be displayed on public score and ranking pages. The owner of a website can verify ownership and hide its public page at any time.

5. Your account

An account is created automatically with the email address used at checkout or login. You sign in with one-time links sent to that address, so keep access to your mailbox secure. You are responsible for all activity under your account and for keeping your information accurate.

6. Prices, taxes and payment

Prices are displayed before purchase, in U.S. dollars, euros or pounds sterling depending on your location. Prices in U.S. dollars exclude sales tax; prices in euros and pounds sterling include VAT where applicable. Taxes are calculated at checkout by our payment processor according to your location and status; business customers who provide a valid VAT number may benefit from the reverse-charge mechanism.

Payments are processed by Stripe. We never receive or store your full card number. You authorize us, through Stripe, to charge your payment method for the amounts shown at checkout and, for subscriptions, for each renewal.

7. Subscriptions and automatic renewal

Weekly and monthly plans are subscriptions that RENEW AUTOMATICALLY at the end of each billing period, at the price shown at purchase, until you cancel. Each paid period triggers a new report for each website attached to the subscription; monthly plans also include weekly monitoring alerts.

In addition, you may launch one manual report per website and per billing period. A report cannot be launched while another one is in progress for the same website. Unused manual launches do not carry over to the next period.

You can cancel at any time, online, from your dashboard (“Manage billing”). Cancellation takes effect at the end of the current billing period, and you keep access until then. After purchase, we email you a confirmation of your subscription terms and of how to cancel.

We will email you at least 7 days before a price change applies to your subscription; you may cancel before it takes effect. If a payment fails, Stripe may retry it, and we may suspend or cancel the subscription if it remains unpaid.

8. One-time reports and credits

A one-time purchase gives you a report credit that you use when you launch the audit. Unused credits do not expire while your account exists.

9. Refunds

Refunds are processed automatically as described in our Refund Policy, which is part of these Terms: the 10-actions guarantee on one-time reports, restoration of credits for reports that cannot be completed, and self-service refund of unused one-time credits within 14 days of purchase.

10. Referral program

When a new customer makes a first purchase through your referral link, they receive 20% off that purchase and you receive a free Focus report credit. Rewards have no cash value and are not transferable. We may cancel rewards in case of abuse (including self-referral) or if the referred purchase is refunded, and we may change or end the program at any time.

11. Acceptable use

You may audit websites that you own or manage, and use publicly available information about other websites for benchmarking. You must not: use the Services to attack, overload or disrupt any website; circumvent access controls, usage limits or security measures; scrape, copy or reverse engineer the Services; resell access to the Services other than through the Agency plan; send reports or alerts to recipients without a lawful basis; or use the Services for any unlawful, infringing or deceptive purpose.

Our crawler, DigitMeBot, follows the robots.txt rules addressed to it and fetches a limited number of pages at a low rate.

12. Agency plan and white-label

The Agency plan lets you present reports under your own brand to your clients. You are responsible for your relationship with your clients, for having their authorization to audit their websites and to share their data with us, and for the recipients you add.

Each website slot included in a subscription is tied to one domain. Its domain cannot be changed; to audit another website, add it within the number of websites included in your plan. Reusing a slot to audit a succession of different websites is not permitted.

13. Integrations

You may connect Google Search Console and Google Analytics in read-only mode. You can disconnect them at any time. Your use of Google services remains subject to Google's terms.

14. Intellectual property

We own the Services, including the software, methods, templates and content we provide, and all related intellectual property rights. You keep all rights to the information you submit.

Each report is licensed to you on a perpetual, worldwide, royalty-free basis: you may use, copy, modify and share it for your business purposes, including with your clients. If you send us feedback, we may use it without obligation.

ChatGPT, Gemini, Perplexity, Claude and Google are trademarks of their respective owners. DIGIT-ME is independent and not affiliated with, sponsored or endorsed by them.

15. Privacy and data processing

Our Privacy Policy explains how we handle personal information. When we process personal data on your behalf (for example report recipients or data from connected Google accounts), our Data Processing Agreement applies and forms part of these Terms.

16. Compliance findings are not legal advice

Accessibility, privacy, security and other compliance findings are technical observations and implementation guidance. They are not legal advice and do not certify compliance with any law or standard.

17. Disclaimers

THE SERVICES AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND USD 100. These limits do not apply where the law does not allow them.

19. Indemnification

You will defend, indemnify and hold harmless DIGIT-ME and its members, managers and service providers from any third-party claim, loss or expense (including reasonable attorneys' fees) arising from your misuse of the Services, your breach of these Terms or your violation of any law or third-party right.

20. Termination

You can delete your account at any time from your dashboard. Deletion is immediate: your websites and reports are erased, and any active subscription is cancelled without refund of the current period. Billing records are kept for 7 years as required by law.

We may suspend or terminate your access if you breach these Terms, fail to pay, or if required by law. Sections that by their nature should survive termination (including 14, 17, 18, 19 and 22) survive it.

21. Changes

We may update the Services and these Terms. We will notify existing customers of material changes by email or in the dashboard at least 15 days before they take effect. If you do not agree, you may cancel before that date; continued use after the effective date means you accept the updated Terms.

22. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before starting any proceeding, please contact us at contact@digit-me.com; we will try to resolve the dispute informally within 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in the State of Delaware, and each party consents to their jurisdiction. EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.

If you are a consumer residing in the European Union, the United Kingdom or another country whose law gives you mandatory protections, nothing in these Terms deprives you of those protections, including the right to bring proceedings in the courts of your country of residence.

23. General

These Terms, the Refund Policy, the Privacy Policy and the Data Processing Agreement are the entire agreement between you and us about the Services. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.

You agree to receive notices electronically. We send notices to the email address of your account; you can reach us at the address below. These Terms may be translated for convenience; the English version prevails.
